Thank you for contacting the FCC regarding possible violations of the Telephone Consumer Protection Act ("TCPA") and the Commission's telemarketing and junk fax rules. Information provided in consumer complaints like yours helps the Commission to combat abusive or unlawful practices in these areas, including taking enforcement actions against individuals or companies. In this regard, the Communications Act authorizes the Commission to issue citations and, in some cases, impose substantial fines upon entities that violate telemarketing and junk fax rules.

Although the Commission does not resolve individual complaints, each complaint is individually analyzed and assists us in enforcement actions to protect consumers like yourself. You should be aware that the TCPA also provides for enforcement of the telemarketing and junk fax rules by state attorneys general and by individual consumers. With respect to the latter, the TCPA permits individuals who have received certain unlawful telemarketing, such as junk faxes or telemarketing calls, to sue the violator in state courts where they may be awarded up to $1500 for each violation.

Complaint was filed because this local handyman asshole keeps robocalling us offering chimney sweeping and bullshit, and leaving a different phone number to call him back. I did one time, and told him we are on the Do Not Call list and that he should stop his robocallers from calling us, and he got all pissy with me, cursing me out and yelling... This time when he called (it's been a while), I took down the exact time and phone number he called from, and phone number he left to call him back at (different), and filed a complaint. I'm glad I wasted my time. Really glad. I guess next time I call the police instead?

Your best bet would be your state attorney general's office, if there is a state statute against this kind of thing.

That does count as harassment. I would discuss this with a law enforcement officer if you know one personally.

I could do that, but it's one particular outfit and he keeps calling. I specifically asked him to stop and he won't, in fact HE yelled at ME for calling him to ask him to stop, so now it's on another level. What's the point of a "Do Not Call list" if there is no enforcement for it? Robocalls, political calls, junk calls... makes the home phone something we all yell "No, do NOT answer the phone" to the kids. The only reason we still have a home phone is that we have young kids in the house. I'm all for getting rid of it completely but my wife isn't there yet. I thought submitting a pile of useful information to the FCC would help, but as this response (literally months later I might add - I actually forgot what this was about) shows THAT doesn't work either.

I kinda figured the FCC was the top of the chain for this. I would hope the AG's office has better things to do, but maybe they can get the guy to stop blindly hiring robocallers to do his dirty work.

haha awesome, I should! Sign me up!!! I think he uses a cellphone and gets a new number every time he calls. It's definitely the same guy and the same company, but the phone numbers are always different.

Take the motherfucker to court. Show documentation of every time he has robocalled you. Remember, that's up to $1500 for each violation. Also robocallers are not likely something he has set up in his basement; generally a service like Five9 is used. They record calls; you should be able to get that information as well. Show that not only does he repeatedly unleash the robocaller on you, but has been unwilling to stop despite numerous requests, and your case is shut. Tack on some extra cash for your wasted time and emotional distress, and I'll bet your number will be magically removed right quick!

In October 2013, the FCC's rules changed. It is now expressly illegal to use an autodialer (or campaign system that could be an autodialer) or robocall people at their cell phone or landline number unless express consent has been given and can be provided at request. An "established business relationship" between you and the business is no longer enough to pass. This has damaged/shut down a lot of OBTM centers :)
